That's very true, it may have been used earlier though not officially adorned (if that's a good phrase to put it) by the US Supreme Court.

In a way I do believe commanders do have to bear some degree of burden on the actions and consequences of war. Whether or not it goes all the way up to the head of the royal family is up for debate, however.
